Welcome to Damaura. These Terms of Service ("Terms") govern your use of the Damaura mobile application, the Damaura web app and related services (collectively, the "Service") published and operated by TACHYS X SDN. BHD. ("Tachys X", "we", "us", or "our"), a Malaysian company, in collaboration with SERENITILABS SDN. BHD. ("Serenitilabs"), which develops Damaura.

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

1. Service Description

Damaura is an AI-powered wellness companion designed to provide:

• Supportive conversations for emotional wellbeing
• Optional faith-informed guidance and reflections (such as the Islamic layer)
• Mood tracking and self-reflection tools
• Wellness insights and pattern recognition

3. Eligibility

To use Damaura, you must:

• Be at least 17 years of age
• Have the legal capacity to enter into these Terms
• Not be prohibited from using the Service under applicable laws

4. User Accounts

When you create an account, you agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

5. Acceptable Use

You agree NOT to use the Service to:

• Violate any applicable laws or regulations
• Harass, abuse, or harm another person
• Impersonate any person or entity
• Attempt to gain unauthorized access to our systems
• Transmit malware, viruses, or harmful code
• Use the Service for any commercial purposes without authorization
• Attempt to manipulate or abuse the AI system

6. Intellectual Property

The Service and its original content, features, and functionality are owned by or licensed to TACHYS X SDN. BHD. and are protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of any content you submit, but grant us a license to use, store, and process it to provide the Service.

7. AI-Generated Content

Damaura uses artificial intelligence to generate responses. You acknowledge that:

• AI responses may not always be accurate or appropriate
• AI cannot replace human judgment or professional advice
• You should not rely solely on AI responses for important decisions
• We continuously work to improve AI quality but cannot guarantee perfection

8. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

9. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" without warranties of any kind
• We do not guarantee uninterrupted or error-free service

• Our total liability shall not exceed the amount you paid for the Service

You agree to indemnify and hold harmless TACHYS X SDN. BHD., SERENITILABS SDN. BHD., their affiliates, and their respective officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

We may terminate or suspend your account and access to the Service:

• For violations of these Terms
• For conduct that we determine is harmful to other users or the Service
• At our sole discretion, with or without notice

You may terminate your account at any time through the app settings.

We reserve the right to modify these Terms at any time. We will notify users of significant changes via the app or email. Continued use of the Service after changes constitutes acceptance of the new Terms.

These Terms shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law provisions.
